California has adopted, in the California Fair Employment and Housing Act (FEHA) an extensive statutory scheme to prevent sexual harassment and employment discrimination in the workplace. FEHA provides an overlapping statutory basis for the recovery of damages for sexual harassment and employment discrimination based on race, religious preference, gender, or age, to the federal Equal Employment Opportunity Act (EEOA)
Employment decisions of all kinds, including promotion, demotion, assignment, re-assignment, lay-off, and termination, are unlawful if made on the basis of race or religious preference are almost always unlawful and discriminatory. Employment decisions based on gender or age are, with some exceptions, also unlawful and discriminatory.
In most employment discrimination cases, attorney fees are separately awarded by the court to a successful claimant, leaving the entire amount of awarded damages available to compensate the claimant who has been harmed by the discriminatory employment decisions. In cases where the discrimination or harassment has been intentionally and knowingly undertaken, punitive damages are also available to deter wrongdoing in the future.
