A common carrier is one who represents to the public that its business is one of transporting persons or cargo from place to place for compensation, and such services are generally open to the public. Special duties arise from the special relationship between common carriers and passengers based on the assumption of responsibility for the safety of others. California Civil Code section 2100 states that a carrier of persons for reward (or compensation) must use the utmost care and diligence for their safe carriage, must provide everything necessary for that purpose, and must exercise to that end a reasonable degree of skill. In order to prevail on a claim for damages arising out of injuries incurred in an accident while riding in a vehicle operated by a common carrier, you must prove the common carrier breached a duty to you and that the breach caused the injury. No matter how severe the injury the common carrier is not automatically responsible.
