Sexual Transmitted Disease
In California, a person who becomes infected with a sexually transmittable disease such as HIV, herpes, genital warts (human papilloma virus), syphilis, gonorrhea, chanchroid (Haemophilus ducreyi), by a sexual partner who knows or has reason to know that he or she has such an infection, may recover compensatory damages against the offending person. If the infection is transmitted by a person with actual knowledge of his or her infection and is undertaken with conscious disregard for the high probability of transmitting the disease, punitive damages are also recoverable.
